Lost penis not doctor’s fault, jury says

Dr. Laurentia Boeru is not responsible for Enrique Milla losing his penis to flesh-eating bacteria, a Miami jury ruled on Tuesday, WSVN TV reported.

Milla sued the anesthetist after doctors had to amputate his penis because gangrene set in after penile-enhancement surgery.

Boeru argued Milla contracted the infection because he didn’t take care of himself after the procedure.

“To have three years; it is a toll taken out of my life,” the Romanian doctor said of the proceedings, according to WSVN.

The four-man, two-woman panel needed less than an hour to return a verdict in the malpractice lawsuit, Courthouse News Service reported.

Milla has high-blood pressure and diabetes, and required surgery to correct erectile dysfunction.

Nine days after the procedure, gangrene set in.

He sued for tens of millions, saying Boeru didn’t take into account pre-existing medical conditions and should've never cleared him for surgery.

In his defense, Boeru said doctors define post-op care as between six and 24 hours, and the patient must take responsibility after that.

To make matters worse, US authorities deported Milla back to Peru after he made the claims.

He testified at the trial via Skype.

“I’m sure had the clients or plaintiffs been here, perhaps it would have been a different result,” Milla’s lawyer, Spencer Aronfeld, told CNS. “But, in the end, no matter what the jury says, Mr. Milla is going to have to live with the consequences of the decision that Dr. Boeru made on that day for the rest of his life.”

Milla also sued the urologist in the case, but that was settled outside of court.
