Instant Heart Attacks all around after deli wins burger battle

New Yorkers rejoice: you have all the access you want to Instant Heart Attacks.

The 2nd Avenue Deli won a court battle with its bi-coastal rival – the Heart Attack Grill in Las Vegas – to produce the sweat-inducing sandwich, along with something called the Triple Bypass.

“We feel that we’ve been vindicated,” 2nd Avenue Deli owner Jeremy Lebewohl told The Daily News on Friday. “We’re doing what we’ve always done, what we do best: selling sandwiches.”

The Heart Attack Grill in Las Vegas claimed copyright infringement, Reuters reported.

US District Court Judge Paul Engelmayer said there’s little chance customers could become confused.

The judge said 2nd Avenue Deli is Kosher, so it can’t serve meat and dairy together, giving Heart Attack Grill little worry about since its burgers almost exclusively feature cheese — prominently.

“This is a fight that was not of our choosing, and our customers are the true victors,” Lebewohl told Reuters.

The Instant Heart Attack is a “sandwich consisting of two large potato pancakes with your choice of corned beef, pastrami, turkey or salami,” and retails for $24.95. It is 804 calories.

The Triple Bypass goes for $34.95. You get an extra latke, and almost everything else.

The grill’s owner, Jon Basso (aka Dr. Jon), said 2nd Avenue Deli is just trying for cheap headlines with dubious lawsuits.

“I’m compelled to continue to pay fortunes in legal fees in order to keep copycats at bay,” he told The Daily Mail. “We had already reached an amicable settlement back in 2011, but they realized that they could get a lot of press if they filed suit.”
