Texas dad David Barajas kills drunk driver who killed sons

A Texas father has been charged with murder in the fatal shooting of a suspected drunk driver who authorities say killed his two sons.

David Barajas, 31, and his sons were just yards from their Houston-area home Dec. 7 when a car struck them, The Associated Press reported.

David Jr., 12, died at the scene while Caleb, 11, died later at a hospital.

Barajas and his sons were pushing the family's disabled pickup truck down a dark, rural road with the boys' mother and two younger siblings inside, ABC News reported.

They were struck by 20-year-old Jose Banda, who was intoxicated at the time, police said.

Neighbors reported hearing gunshots minutes after the crash, and Banda was later found shot in the head, CBS News reported.

Witnesses said they saw Barajas walk to his house shortly after the crash and then return

Authorities haven't found the murder weapon, but told the AP they did find the same ammunition that killed Banda at Barajas' house.

Officials are waiting for results of DNA and gunshot residue tests, the Houston Chronicle reported.
