Attorneys for Katie Holmes and Tom Cruise have said the divorce is still in its early stages, according to the Los Angeles Times.
Holmes' attorneys has said she has no plans to seek any type of emergency custody or spousal support.
TMZ reported Cruise and Holmes are currently negotiating a settlement including child custody, visitation, child support and property settlement – and there are no immediate plans to go to the courts.
The website said the split could be settled out of court and possibly even in New York, where Holmes has a higher chance of getting sole custody of her daughter Suri.
The Los Angeles Times said negotiations were "calm."

Cruise attorney Bert Fields, told the BBC that Cruise is considering his options. "Tactically we can't say where Tom will file a divorce case."
Scientology and what role it would play in the upbringing of Suri is said to be a major reason for the divorce. Cruise is a prominent Scientology member and since the split, Holmes claims she is being followed by Scientologists who are trying to intimidate her and her daughter.
